Your app licence
These terms govern your use of TOM Driver and are between you and TOM Intelligence LTD, registered at 1110 ELLIOTT COURT COVENTRY BUSINESS PARK, HERALD AVENUE, COVENTRY, WEST MIDLANDS, UNITED KINGDOM CV5 6UB. TOM grants you a limited, non-exclusive licence to install and use the app on a supported device for authorised courier work. Your operator authorises access to its records. Public installation does not grant access to company information. The app licence is separate from your employment, subcontract or other work agreement and does not change your pay or employment status.
Accounts and intellectual property
Use your own assigned account, keep credentials private and report suspected misuse promptly. Do not allow another person to perform work under your identity. The app, software and branding remain the property of their respective owners. Rights in work records are governed by the relevant work agreement and applicable law. Do not copy, distribute, sell or modify the software except where permitted by its licence or applicable law. Downloading the app does not transfer ownership.
Safe use
Stop in a safe place before entering messages, changing assignments, scanning or recording evidence. Do not hold and use a phone while driving, including when stopped in traffic. A mounted or hands-free device must not distract you or prevent proper control. Navigation, routes and arrival estimates are aids; obey road signs and safety requirements. TOM Driver is not an emergency service. Contact the emergency services directly when needed.
Evidence and acceptable use
Submit accurate statuses, scans, times, expenses and evidence for the work performed. Do not fabricate signatures, impersonate recipients or falsely mark work completed. Raise factual mistakes with operations so they can be investigated while preserving history. Do not access records without authorisation, bypass controls, disclose confidential information outside authorised channels, introduce malicious code, harass users or upload unlawful or unrelated material. These terms do not restrict protected reporting or statutory rights.
Connectivity and unfinished work
Some actions need a connection and server confirmation. Offline work may remain queued until accepted. Check submission status and contact operations if a queue does not clear. Do not uninstall, clear storage or reset the phone while it contains unsent work. A queue does not guarantee every feature works offline or that every device failure can be recovered.
Privacy permissions and amounts
Read the Privacy policy, Location and worker monitoring notice and Device storage notice before using the relevant features. You can manage phone permissions in settings, although a related feature may then be unavailable. Discuss any work consequence with your operator. Pay, charge, expense and payout-request displays are operational records subject to your work agreement and review. The app does not receive or move funds. Raise discrepancies with the operator.
Assistant guidance
Where an assistant is enabled, its answers can be incomplete or wrong. Confirm operational instructions with dispatch. It does not replace a dispatcher, professional advice or your responsibility to act safely. Do not submit information unnecessary for the question.
Updates support and access restrictions
Install supported updates through the authorised distribution route and keep your device secure. The operator or TOM may restrict access for loss of authorisation, security concerns or misuse, with notice where reasonably practicable. Suspension does not fulfil deletion of an account. Contact jeet@xtramilecouriers.co.uk for TOM support or concerns and contact your courier operations team for assigned work. Service availability can be affected by devices, networks, maintenance and external providers; no uninterrupted-service promise is made.
Charges and responsibility
The app is offered as a free download. Your mobile or internet provider may charge for data or connectivity, and your separate work agreements remain applicable. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or liability that cannot lawfully be excluded. No additional liability cap is imposed by these terms. Statutory and accrued rights remain protected.
Changes and governing law
TOM may update these terms when the service or applicable requirements change and will identify the revised version. Changes do not retrospectively remove accrued rights. English and Welsh law governs this app licence, with disputes subject to the courts of England and Wales, except where mandatory law gives you rights or a court route elsewhere.
